    An NRI is a Non-resident Indian who stays in a foreign country for employment or business purposes or stays abroad under certain circumstances for an uncertain duration. Non-resident foreign citizens are at par treated as Non-Resident Indians (NRIs).� 

    PIO means a Person of Indian origin who at any time held an Indian passport or whose parents or grandparents are Indian citizens as per the Constitution of India or Citizenship Act, 1955.

    An OCI is a person� 

    • who has citizenship of another country, at the same time, held Indian citizenship too.� 
    • He/she was eligible for Indian citizenship anytime after or at the time of the commencement of the Indian Constitution.
    • He is a citizen of another country, but belongs to a territory that became part of India after INdependence. An OCI can also buy a property in India.

    According to the RBI guidelines, the following can freely purchase property in India:

    • An NRI (Non-Resident Indian)
    • A PIO
    • An OCI

    As all three categories are referred to as NRIs, any of the aforementioned can buy immovable properties in India.

    According to the RBI guidelines, NRIs are allowed to purchase residential properties and commercial assets. But they are forbidden from purchasing any agricultural lands, farmhouses, and plantations. If they are willing to invest in India and planning to purchase any of the above, they need to specially apply for permission from the RBI.

    NRIs may need the following documents to purchase a property in India

    • PAN Card.
    • Power of attorney (POA)
    • A copy of the passport of the buyer
    • An NRE or NRO account.

    Any NRI who wants to invest in India should own the following documents:

    • Authorized building plan
    • Possession letter from the builder
    • NOC from Electricity Supply, Pollution Control Board, Water Department
    • Occupancy certificate
    • Sale agreement between the builder and previous owner (if applicable)
    • Allotment letter
    • Khata certificate and extracts
    • Encumbrance certificate (in case there is a previous buyer)

    Following are the guidelines for an NRI to avail home loan that caters to investment in India:

    • The bank that is providing the loan will decide the period of repayment.
    • RBI or National Housing Bank decides the Rate of interest� 
    • The loan amount will not be credited to the NRE/Foreign Currency Non-Resident (FCNR)/Non-Resident Non-Repatriable (NRNR) account
    • Loan installments will be paid through normal banking channels

    Yes, properties other than farmhouses and agricultural lands can be bought by NRIs.

    NRIs should file income tax returns for investments if:

    • Tax payable income in India during that year is above 1.6 lakhs
    • Short and long-term capital gains from the sale of invested properties or assets were made.

    NRIs who are looking to invest in India will be exempted from filing income tax returns if:

    • Long-term capital gains were from equity mutual funds or shares
    • If tax has been deducted at the source from income through capital gains income or investments.
